Berger, Young & Associates Ltd. (Berger Young) is an international legal consulting firm that provides investment, finance, corporate structuring and other transaction services in respect of foreign investments in Cuba since 1998.
Its founding partners are Sebastiaan A.C. Berger and Cameron Young.
Berger Young has extensive on-the-ground experience in Cuba and a corresponding office arrangement with the Cuban business law firm Consultores y Abogados Internacionales (CONABI).
Since 1994, the Cuban economy has moved gradually towards a mixed economy and there has been a steady increase and diversification of the foreign capital invested in the country. Although traditional exports such as tobacco, commercial fisheries and sugar remain important export sectors, the rapid rise of tourism, nickel, oil & gas and telecommunications are illustrative of the ongoing evolution and modernization of the Cuba economy. As a result of these developments, the nature of conducting business in Cuba and the body of law applicable to foreign investment transactions have also undergone profound change. Today, this process is accellerating and tomorrow US investors may also become involved.
Berger Young was formed by two partners, Berger and Young, in order to provide independent, legal and investment advisory services to foriegn investors in Cuba. Sebastiaan and Cameron are both lawyers, trained in important international law firms and both have lived and worked in Cuba for over 10 years. They met in Havana in 1998 and decided that the opportunities of the Cuban market place were likely to expand significantly in the years to come and that their strategy of balancing on-the-ground expertise with international transaction standards put them in a unique position to advise foreign investors on the potential benefits, but also the potential risks, of this fascinating business environment and country.
In a complex niche market, the philosophy of Berger Young is to offer the full spectrum of transaction services from beginning to end.
We provide the following services to foreign investors:
- identification of investment opportunities and introduction of foreign investors to Cuban companies and projects
- relevant market research
- due diligence investigations
- drafting and negotiation of investment and transaction documentation, including delivery of all local legal opinions
- assistance in the corporate and financial structuring of investments
- attraction of capital and strategic partners for projects
- coordination of transactions
- supervision and monitoring of investments once they are made.
